Terms of Service

These terms explain how you can use jaysrocky.com and how we work together when you order a service from Jays Rocky.

About these terms

These Terms of Service (“Terms”) apply when you use jaysrocky.com or order a service from Jays Rocky (“we”, “us”), 174 Grand St, Brooklyn, NY 11211, United States. By placing an order, accepting a quote or paying an invoice, you agree to these Terms. If you are ordering for a business, you confirm that you are allowed to accept them on its behalf.

A written proposal, quote or order description that we agree with you forms part of these Terms. If it says something different from these Terms, the proposal, quote or order description applies.

Our services

We provide SEO, software development (websites, web and mobile apps, business automation and app publishing), digital marketing, social media marketing, lead generation, email marketing, and podcast, music and browser extension promotion. The scope, deliverables, price and timeline of each project are set out in its quote, package description or order.

Quotes, orders and payment

  • Quotes are valid for 30 days unless they say otherwise.
  • Prices are in US dollars. Packages and fixed-price services are paid in full before work starts, unless we agree on milestone payments for a larger project.
  • Monthly plans are billed in advance at the start of each billing period and renew automatically until you cancel. You can cancel at any time and the plan stops at the end of the period you have already paid for.
  • Payments are processed securely by our payment providers. We do not see or store your full card details. Any bank or currency conversion fees charged by your own bank are your responsibility.
  • If an invoice is not paid on time, we may pause work until it is paid.

Delivery and revisions

We start work once payment and the information we need from you have been received. Delivery times are estimates given in good faith; they can move if we are waiting on content, access or feedback from you.

Revisions included in a package or quote are listed there. Requests outside the agreed scope are new work, and we will quote them separately before we begin.

Your responsibilities

  • Give us accurate information and the access we need (for example website, hosting, store or ad accounts) on time.
  • Make sure any content, logos, images, music or other material you give us is yours or that you have permission to use it, and that it does not break any law.
  • Keep ownership of your own accounts. Apps are published, and ads and listings are run, under your own developer, store and platform accounts unless we agree otherwise.
  • Follow the rules of the platforms you use, such as Google, Apple, Meta, Spotify and app store policies.

Results and third-party platforms

We use white-hat methods that follow platform guidelines, and we never use bots or fake engagement. Search rankings, traffic, streams, listens, downloads, leads and sales depend on search engines, app stores, streaming services and other platforms that we do not control, so we cannot guarantee a specific ranking, number or outcome unless a guarantee is written into your quote.

Approval of apps, ads, listings and playlist placements is decided by the platform. We help you meet their requirements and respond to rejections, but the final decision is theirs.

Ownership and intellectual property

Once a project is paid in full, you own the final deliverables we create for you, such as designs, content and the source code of your custom software. We keep ownership of our own tools, templates, know-how and any third-party or open-source components, which you receive under their own licences. Unless you ask us not to, we may show the finished work in our portfolio without sharing confidential information.

Confidentiality

We keep the business information, logins and data you share with us confidential and use it only to deliver your services. How we handle personal information is explained in our Privacy Policy.

Cancellations and refunds

You can cancel an order or a monthly plan by contacting us. Whether you are entitled to a full or partial refund is explained in our Refund Policy, which forms part of these Terms.

Limitation of liability

We provide our services with reasonable skill and care. To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost data or lost business, or for problems caused by third-party platforms, hosting providers or changes to their rules. Our total liability for any claim about a service is limited to the amount you paid us for that service.

Use of this website

You may use jaysrocky.com to learn about our services and contact us. Please do not copy the site's content or design for commercial use, try to break or overload it, or send spam through its forms.
